By visiting or shopping at this web site, you accept the following
terms and conditions. Please read them carefully.
FLOOR PLANS
For Floor Plan orders, this confirmation represents an estimate
based on the information provided or is set to our minimum fee.
The actual cost will be determined based on the actual measurements
of the property.
PHOTOS
Standard Still Photo dimensions will be 1600 x 2400 pixels.
These images will print out at approximately 5" x 8"
at 300 ppi (pixel per inch). We are not responsible for the
print quality or print dimensions as this will vary significantly
on the type and quality of printer used. If you require larger
resolution or print sizes, please request our High Resolution
Magazine Quality upgrade.
High Resolution Photos will be 4000 x 2600 pixels. These images
will print out at approximately 8.5" x 13" full bleed at 300 ppi
(pixel per inch).
All photos will be shot at the property location. If you require
additional photos at other locations (e. g. parks, school, neighbourhood)
there will be an additional fee. Please contact us for more
details.
Our policy is not to remove permanent structures from any photos using photoshop or any other manipulations in post-production. If the structures are temporary and can or will be removed (e.g. garbage cans, for sale signs, etc), then we may accommodate the request or we will crop the photos or panoramas so the temporary structure is not shown. Otherwise we would be deceiving the end-user as to what is actually permanent at the physical location and would be compromising our ethical standards as a premier supplier of visual content. There may be additional fees for image manipulation depending on the time estimate of the work.
APPOINTMENT TIME
For orders that are placed before 3:30pm, we will contact you
by the end of the business day. We make appointments based on
availability. If you require a rush appointment, there is a
Rush Appointment fee. This does not include rush delivery of
the photos and SeeVirtual tour. Please inquire for more details.
DELIVERY TIME
Within 2 business days of the appointment we will email you
a copy of all the still photos and a link to your SeeVirtual
tour page. If you require rush delivery of the photos and/or
SeeVirtual tour, there is a Rush Delivery fee. This does not
include a Rush Appointment. Please inquire for more details.
IMPORTANT BOARD PHOTO & LINK DELIVERY INFORMATION
The photos and SeeVirtual tour link will be sent to the Real
Estate Board at the same time we send them to you (assuming
a MLS # exists). IMPORTANT: It can take the Board up to 2 business
days before your photos and multi-media link are online (depending
on the Board's volume). If you DO NOT currently have an MLS
# for your listing, don't worry, we will check for it daily
and submit the photos and link to the Board once it is available.
To help speed up the process you can email tours@seevirtual360.com
the MLS # once you receive it.
For any listings on the Real Estate Board of Greater Vancouver
(REGVB), we will send the first photo AND the SeeVirtual tour
link on your behalf. The REGVB charges its members $25 for any
third party that sends photos #2-20 on the member's behalf. You must let us know if you would like us to send all 20 photos
on your behalf and incur the $25 charge directly from the board.
If you want to upload the photos yourself, and avoid the $25
fee, please contact your office admin or the REBGV for instructions
on how to upload your photos.
For any listings on the Fraser Valley Real Estate Board (FVREB)
all
20 photos and SeeVirtual tour link will be sent for free. If
you want the photos uploaded sooner you can upload them yourself.

VIEW PROPERTIES, SUNNY DAYS, WINDOW VIEWS and the WEATHER
As part of SeeVirtual's high quality photo editing, we create
a blue sky in the main exterior photo to appear on MLS regardless
of the weather on the day of the appointment. If your property
has a spectacular view, exterior, or garden to showcase and
you require clear blue skies in all the exterior photos, you
must let us know before booking the appointment. We will try
our best to accommodate and get you an appointment on a clear
sunny day, but we do not reserve appointments based on the weather. If you require views and exteriors to be seen from all interior
photographs, then please request our WindowView Enhancement
upgrade.
YOUR CONTACT INFORMATION
If you have not done so already, please send us the contact
and personal information you would like to show up on your SeeVirtual
tour and on all additional advertising (e.g. Craigslist, Kijiji,
YouTube). Any changes requested after the tour or advertisements
have been posted will be subject to an administration fee. The
contact and personal information includes:
1. Your First and and Last name as you would like it to appear
2. Your Photo
3. Your Company Name
4. Your Phone Number(s): Mobile, Office, Other
5. Your Email address
6. Your Website address
7. If applicable, all the Co-listing Agent's information
LEGAL
1. You will assume all risk for damage and loss resulting from
the preparation, assembly, use and operation of the SeeVirtual
Marketing & Photography's (the "Company") products
and services. You agree to release the Company from all liability
for any damage or loss resulting from your use of the products
and services. You will indemnify the Company against all claims
and expenses, including legal fees, on a full indemnity basis,
arising from injury to person or property resulting from the
preparation, assembly, use and operation of the products and
services.
2. You acknowledge and agree that the Company, in its sole
discretion, will decide if the weather conditions are suitable
for the taking of photograph(s) and pan(s) for you. If the Company
chooses to take the photograph(s) and pan(s) on the agreed upon
appointment date under prevailing or unexpected weather conditions,
you will pay the Company the invoice amount. However, if the
Company, in its discretion, or for reasons beyond its control,
chooses not to take the photograph(s) and pan(s) on a particular
date for you, you agree to reschedule the appointment to another
date, as agreed by you and the Company. It is agreed by you
that the Company will not be liable to you for any expenses
or losses incurred by you as a result of an appointment cancelled
by the Company. You agree if you do not provide at least 24
hours advance written notice to the Company prior to the scheduled
appointment to request a change in date and/or time of the appointment,
the Company can charge you a $50 cancellation fee. The Company
reserves the right to charge a $30 late fee if you are significantly
and/or consistently late for your appointment(s). For these
purposes, significantly late has been defined as over 20 minutes
without notice.
3. You agree the Company retains the right to the full invoice
amount after any work has been completed.
4. You agree to incur additional costs or pay full package
price for the partial work that is completed during the allotted
time for the appointment if the property is not properly staged
or prepared prior to the arrival of the photographer.
5. You agree to accept that the pan and photograph choices
will be based on the discretion of the photographer if you do
not specify the specific pan and photograph locations before
or during the appointment.
6. You agree to pay interest at the rate of 2% per month (24%
per year) on unpaid amounts overdue for 30 days or more.
Real Estate Customers:
You may cancel your order for our products and services at no
cost by providing a notice of a minimum of 24 hours before the
agreed upon appointment time. You must cancel your service request
via telephone or email. However, once any of the work is performed
or services are rendered by SeeVirtual Marketing & Photography
Inc or any of its suppliers contracted to perform or produce
any part of the product and/or service, or you did not give
adequate notice time for a cancellation or request a change
of appointment, you are liable for full payment of the entire
order amount. You are liable for all work performed and services
rendered.
If there is a conflict or disagreement with the product or
service and it is reported within a reasonable time period (Approximately
7 days), we will do everything possible to rectify the problem
and make you happy. This is handled on a case by case basis
depending on situation and may include re-performing and/or
reproducing parts of the product and/or service, and possibly
providing a discount or future discount on your account. Reshoots
and/or discounts must be first be approved by a company manager.
Please allow 10 business days for any approved refunds
If a CD is damaged or not received and is reported within a
reasonable time period (Approximately 21 days), we will be pleased
to send a replacement CD to you at no extra charge.
Real Estate Customers:
Virtual tours and/or photographs will be completed and emailed
to the customer within 2 business days of the appointment. Single
CD orders (less than or equal to 5) will be mailed out to the
customer's address via Canada Post unless another shipping method
has been requested. In the case of a high-volume CD order (greater
than 5), the shipping cost will be charged to the customer directly
or the customer's courier account will be used to send the package.
1. You recognize and agree that the photographs, panoramas,
video, voice-over, floor plans, CDs and feature sheets and all
other files and photographs relating to the Package are the
exclusive property of the Company and that nothing in this Agreement
will be construed as granting you any rights, by license or
otherwise, with respect to the Package. You do not own the Package;
you only have the right to use the Package as specified in this
Agreement (the "Usage Rights"). You agree the Company
may use the photographs or modifications of the photographs,
pan (multiple photographs stitched together to form a pan (the
"Pan")), video, voice-over, floor plans, CDs and feature
sheets on the Company's website and in the Company's promotional
material including third party websites, brochures, magazines,
newspapers and trade-show materials.
2. "Usage Rights" mean the following for the Packages
unless the Company otherwise agrees in writing:
i. For Corporate Virtual Tour Packages: Usage Rights means
the Company is selling you the right to use the photographs
as well as the Pan(s) as you deem appropriate;
ii. CDs: Usage Rights means you cannot copy any part of the
Pan(s), photograph(s), video, voice-over, floor plans, or information
of any kind whatsoever stored on any part of the CD.
iii. Voice-overs & floor plans: Usage Rights means you will
not alter, copy, delete or use the voice-overs, CD's or floor
plans for any other purposes or products or on any third-party
websites.
If you order any packages with unlimited usage rights, the
Company will not be responsible for the implementation and use
of the photograph and the Pan(s) on your website or any third-party
website(s). The files will be made available to you for download,
upon receipt of payment, via the Company's File Transfer Protocol
server.
3. The photograph resolution for all packages will be maximum
of 1300x1800 pixels and minimum of 1300x1000 pixels. The Pan(s)
will have a height of 800 pixels and a width between a maximum
of 10,000 pixels and minimum 1000 pixels. The photograph(s)
and the Pan(s) will be in the JPEG format (.JPG or.JPEG file
extension).
The photograph resolution for the High-Resolution option will
be maximum of 2400x3600 pixels and minimum of 2000x3000 pixels.
The Pan(s) will remain at the same resolution regardless if
the High-Resolution option is ordered. The photograph(s) will
be in the JPEG format (.JPG or .JPEG file extension).
The Company will not guarantee the printable size and printable
resolution of any of its photographs as it will depend upon
the printer and software being used. The Company can only give
an approximation of print size; for the standard photograph
resolution, the approximation is 4x6 inches and for the High-Resolution
option, the approximation is 8X12 inches. The approximations
are based on printing at 300 PPI (Pixels per Inch).

4. You agree not to attempt to modify or reproduce any Package
or part thereof in any way or pass it off as your own.
5. If you do not pay the annual hosting fee or you stop paying
a hosting fee to the Company for your virtual tour on the Company's
website, you agree to your virtual tours to be removed from
the Company website, or if the Company chooses to keep the virtual
tour online, you consent to the Company placing any Company
or third party advertising on your virtual tour pages.
6. You will assume all risk for damage and loss resulting from
the preparation, assembly, use and operation of the Package.
You agree to release the Company from all liability for any
damage or loss resulting from your use of the Package. You will
indemnify the Company against all claims and expenses, including
legal fees, on a full indemnity basis, arising from injury to
person or property resulting from the preparation, assembly,
use and operation of the Package.
7. You acknowledge and agree that the Company, in its sole
discretion, will decide if the weather conditions are suitable
for the taking of photograph(s) and Pan(s) for you. If the Company
chooses to take the photograph(s) and Pan(s) under prevailing
or unexpected weather conditions, you will pay the Company the
invoice amount. However, if the Company, in its discretion,
or for reasons beyond its control, chooses not to take the photograph(s)
and Pan(s) on a particular date for you, you agree to reschedule
the appointment to another date, as agreed by you and the Company.
It is agreed by you that the Company will not be liable to you
for any expenses or losses incurred by you as a result of an
appointment cancelled by the Company. You agree if you do not
provide at least 48 hours advance written notice to the Company
prior to the scheduled appointment to request a change in date
and/or time of the appointment, the Company retains the deposit.
8. You agree the Company retains the deposit if you decide
to cancel the package after the non-refundable deposit has been
paid.
9. You agree that the order will be cancelled and you will
forfeit the deposit to the Company if the photographer's appointment
and all photographs are not completed within one (1) year from
the date the non-refundable deposit is received.
10. You agree to incur additional costs or pay full package
price for the partial work that is completed during the allotted
time for the appointment if the property is not properly staged
or prepared prior to the arrival of the photographer.
11. You agree to accept that the Pan and photograph choices
will be based on the discretion of the photographer if you do
not fill in the Virtual Tour Information Sheet or specify through
your online order, in which case the specified choices will
appear above in the Order Details.
12. You agree to allow up to 30 days for product delivery from the date of the photography appointment. Our target delivery timeline is ten (10) business days but can fluctuate based on time of year and the number of projects in post-production.
13. You agree to pay interest at the rate of 2% per month (24%
per year) on unpaid amounts overdue for 30 days or more.
14. These terms constitutes the entire agreement of the parties
and will not be changed or discharged except in writing.
Corporate Customers:
Please refer to the Corporate Terms of Service for the Return/Refund
Policy. Please discuss any concerns or details with your sales
representative.
Corporate Customers:
Virtual tours and/or photographs will be completed and emailed
to the customer within 10 weeks of the appointment unless specified
otherwise in the order details. Completion and delivery times
for corporate products and/or service will vary, depending on
the complexity of the order. Single CD orders (less than or
equal to 5) will be mailed out to the customer's address via
Canada Post unless another shipping method has been requested.
In the case of a high-volume CD order (greater than 5), the
shipping cost will be charged to the customer directly or the
customer's courier account will be used to send the package.
All payments are due immediately on their monthly or annual renewal
date. To cancel your subscription or recurring payment, you must
contact us at least five (5) business days prior to your monthly
or annual renewal date. Failure to give this adequate notice may
result result in payment being processed automatically and renewal
of the next subscription period. All payments are FINAL and NO
refunds will be issued once payment has been processed.
TRUTH IN ADVERTISING / INDEMNIFICATION FOR LIABILITY:
Advertiser
is solely responsible for any legal liability arising out of
or relating to (1) the Advertisement, and/or (2) any material
to which users can link through the Advertisement. Advertiser
represents and warrants that the Advertisement and Link comply
with SeeVirtual Marketing & Photography's advertising standards;
and that it holds the necessary rights to permit the use of
the Advertisement and Link by SeeVirtual Marketing & Photography
for the purpose of this Agreement; and that the use, reproduction,
distribution, or transmission of the Advertisement will not
violate any criminal laws or any rights of any third parties,
including, but not limited to, such violations as infringement
or misappropriation of any copyright, patent, trademark, trade
secret, music, image, or other proprietary or property right,
false advertising, unfair competition, defamation, invasion
of privacy or rights of celebrity, violation of any anti discrimination
law or regulation, or any other right of any person or entity.
Advertiser agrees to indemnify SeeVirtual Marketing & Photography
and to hold SeeVirtual Marketing & Photography Management
harmless from any and all liability, loss, damages, claims,
or causes of action, including reasonable legal fees and expenses
that may be incurred by SeeVirtual Marketing & Photography,
arising out of or related to Advertiser's breach of any of the
foregoing representations and warranties. Advertiser agrees
to request that SeeVirtual Marketing & Photography be listed
as an additional insured on any policy issued to Advertiser
pursuant to which there could be coverage for any of the forms
of legal liability described in this paragraph.
LIMITATION ON DAMAGES: IN NO EVENT WILL SEEVIRTUAL MARKETING
& PHOTOGRAPHY BE LIABLE TO SPONSOR FOR ANY SPECIAL, INCIDENTAL,
OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT,
TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT
SEEVIRTUAL MARKETING & PHOTOGRAPHY HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGE.
SeeVirtual Marketing & Photography will remove any ads
that are reported to us as being scams. If one of the advertisements
on our site is not providing what they are advertising to do
so, please email us the details and we will remove the ad.
Your Obligation to Indemnify. You agree to indemnify,
defend and hold SeeVirtual Marketing & Photography harmless
from and against any third party claim, loss, liability, and
expense (including damage awards, settlement amounts, and reasonable
legal fees), brought against any Indemnified Person(s) (SeeVirtual
Marketing & Photography), arising out of Your use of our
advertising options, Your Web site, and/or Your breach of any
term of this Agreement.
Note: Before purchasing ads you must agree to our Advertising
Terms of Service that:
We are not responsible for any of your site’s downtime.
You rent a banner for a period of time, and if your site is
offline during that time, you take the responsibility. We will
not extend your advertising due to these circumstances.
You are NOT allowed to place ads to fraudulent sites,
investment scams, or Ponzi Schemes. We reserve the right to
decline any future publishing of the ads if people complain
to us (no refunds given). We will remove any ads that direct
to any site that is proven to be a scam. We are in no way affiliated
with any of our advertisers and are not responsible for their
actions.
We do not guarantee the activity that your advertisements will
receive, such as the number of clicks you will get.
We reserve the right to determine the size, placement, and
positioning of your advertisements.
You agree to pay for your advertisements in accordance with
our Subscription and Recurring Payments Terms of Service
All content included on this site, such as text, graphics, logos,
button icons, images, audio clips, digital downloads, data compilations,
and software, is the property of this site's owner or its content
suppliers and protected by Canadian, United States and International
copyright laws. The compilation of all content on this site is
the exclusive property of this site's owner and protected by Canadian,
United States and International copyright laws. All software used
on this site is the property of this site's owner or its software
suppliers and protected by Canadian, United States and International
copyright laws.
This site is provided on an “as is” and “as
available” basis. No representations or warranties of any
kind are made, express or implied, as to the operation of this
